Thank you for visiting the Text-Calibur website (the “Site”). The Site is an Internet property of Text-Calibur Inc., (“Text-Calibur,” “we,” “our” or “us”). This Text-Calibur Privacy Policy (“Privacy Policy”) covers our treatment of personal information and other information that we collect when you: (a) access or use the Site and/or services offered on and/or through the site; and/or (b) request to be contacted by us in connection with your use of, or desire to obtain, Text-Calibur Services. Capitalized terms not defined herein shall have the meaning set forth in the Text-Calibur Website Terms and Conditions (“Terms and Conditions”). IF YOU DO NOT AGREE TO TERMS OF THIS PRIVACY POLICY IN THEIR ENTIRETY, YOU MAY NOT ACCESS OR OTHERWISE USE THE SITE AND/OR SERVICES OFFERED ON AND/OR THROUGH THE SITE. 

 

Personal Information Collected: For the purposes of this Privacy Policy, “personal information” shall mean individually identifiable information from or about an individual. We collect personal information from you primarily when you complete an form provided on the Site including any contact form in connection with your request to be contacted directly by Text-Calibur with respect to your use of, or desire to obtain, the Text-Calibur Services. The personal information that you supply on the Site in order to complete any contact form may include, without limitation: (a) first and last name; (b) e-mail address; (c) telephone number; (d) company name (if applicable); (e) company size (if applicable); (f) any comments that you wish to submit; and (g) any and all other information requested on any applicable form. In addition, where you have otherwise entered into the applicable Services Agreement(s) with Text-Calibur, you may be asked to enter your credit card information in order to make payment for the applicable Text-Calibur Services. 

 

Use of Personal Information: When you request to be contacted in connection with the Text-Calibur Services, we use the personal information that you have provide to: (a) respond to your questions or comments; (b) provide support for the Text-Calibur Services; and (c) send you information, periodically, regarding the Text-Calibur Services. In addition, we may file your questions or comments for future reference. 

 

You also agree that we may contact you at any time, via e-mail, telephone or other means, with updates and/or any other information that we may deem appropriate for you to receive in connection with your continued use of the Text-Calibur Services and to market and/or keep you informed of certain other Text-Calibur products and/or services that we think might be of interest to you. If you wish to stop receiving future communications from us, please see the Opt-Out/Unsubscribe section below. 

 

We may permit our third-party agents, service providers and subcontractors to access your personal information, but they are only permitted to do so in connection with performing services for us and/or to operate the Site and/or Text-Calibur Services. They are not authorized to use your personal information for their own benefit. 

 

We reserve the right to release current or past personal information: (i) in the event that we believe that the Site and/or Text-Calibur Services is/are being or has/have been used in violation of the Terms and Conditions, applicable Services Agreements (including any purchase orders and/or contracts associated with the Text-Calibur Services) or to commit unlawful acts; (ii) if the information is subpoenaed; provided, however, that, where permitted by applicable law, we shall provide you with e-mail notice, and opportunity to challenge the subpoena, prior to disclosure of any personal information pursuant to a subpoena; or (iii) if Text-Calibur is sold, merged or acquired; provided, however, that if we are involved in a merger, acquisition or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on the Site of any change in ownership or uses of your personal information, as well as any choices that you may have regarding your personal information. 

 

Credit Card Transactions: Text-Calibur utilizes third party service providers to provide credit card payment processing services. If you choose to make a payment for Text-Calibur Services by and through the Site, the payment information provided will either be collected directly by such third party service provider(s), or we will share that payment information with our contracted third party service provider(s). Text-Calibur requires that its third party payment processing service provider(s) has/have in place privacy policies and practices consistent with this Privacy Policy; provided, however, that we cannot guarantee the privacy practices of our third party payment processing service provider(s). 

 

Cookies: When an end-user visits the Site, Text-Calibur sends one (1) or more cookies and/or gif files (collectively, “Cookies”) to assign an anonymous, unique identifier to the applicable end-user’s computer or other device. A Cookie is a piece of data stored on your hard drive containing non-personally identifiable information about you. Cookies have many benefits to enhance your experience at the Site and are used to improve the quality of the Site and/or any services provided.  

 

Most Internet browsers are initially set up to accept Cookies, but you can reset your browser to refuse all Cookies or to indicate when a cookie is being sent. To disable and reject certain Cookies, follow the instructions associated with your Internet browser. Even in the case where a user rejects a Cookie, he or she may still use the Site. 

 

Behavioral Tracking/Do Not Track: 

 

Text-Calibur does not place Cookies or other tracking technology on the Site that track end-users’ activities after they leave the Site; provided, however, that third parties such as Google may engage in that form of behavioral tracking of end-users that visit the Site. End-users may be able to disable some or all of this tracking activity by utilizing the “Do Not Track” setting or similar options within most major Internet browsers; provided, however, that, to greatest extend permissible under applicable law, we are not responsible for the tracking practices of third parties in connection with the Site. 

 

Third-Party Websites: This Site may contain links to third-party owned and/or operated websites including social media websites. Text-Calibur is not responsible for the privacy practices or the content of such websites. These third-party websites have separate privacy and data collection practices and Text-Calibur shall have no responsibility or liability relating to them. 

 

Security: The privacy of your personal information is very important and as such Text-Calibur endeavor to safeguard and protect our end-user’s personal information. When end-users make personal information available to us, their personal information is protected both online and offline (to the extent that we maintain any personal information offline). When our registration process asks end-users to submit sensitive information (such as credit card information), and when we transmit such sensitive information, that sensitive information is encrypted and is protected. 

 

Access to your personal information is strictly limited, and Text-Calibur takes reasonable measures to ensure that your personal information is not accessible to the public. The servers that store personal information in are kept in a secure physical environment. 

 

Please be advised, however, that while every reasonable precaution available to protect your data has been taken, no storage facility, technology, software, security protocols or data transmission over the Internet can be guaranteed to be 100% secure. Computer hackers may circumvent the security measures and gain access to certain portions of your personal information, and technological bugs, errors and glitches may cause inadvertent disclosures of your personal information; provided, however, that any attempt to breach the security of the network, servers, databases or other hardware or software constitutes a crime punishable by law. For the reasons mentioned above, Text-Calibur cannot warrant that your personal information will be absolutely secure. Any transmission of data done on or through the Site is at your own risk.

 

In compliance with applicable federal and state laws, Text-Calibur shall notify you and any applicable regulatory agencies in the event that Text-Calibur learns of an information security breach with respect to your personal information. You will be notified via e-mail in the event of such a breach. Please be advised that notice may be delayed in order to address the needs of law enforcement, determine the scope of network damage, and to engage in remedial measures. ****

 

Minors: Visitors under eighteen (18) years of age are not permitted to use and/or submit their personal information to the Site nor to contract for any services offered and/or provided through the Site.  Text-Calibur does not knowingly solicit or collect information from visitors under eighteen (18) years of age. ***

 

Opt-Out/Unsubscribe: To opt-out of receiving e-mail communications from us, you can follow the instructions at the end of the applicable e-mail message or email us at info@mysmsbusiness.com. 

 

Notwithstanding the foregoing, we may continue to contact you for purposes of communicating information relating to your request for My SMS Business Services, as well as to respond to any inquiry or request made by you. To opt-out of receiving My SMS Business Services-related and inquiry response-related messages from My SMS Business, you must cease requesting and/or utilizing the My SMS Business Services. 

 

Deleting and Updating Your Information: At your request, My SMS Business will inform you of what personal information we have on file for you. In addition, at your request, we will remove personal information that you have provided to us, or that we have collected. You may do so by contacting us via e-mail at: info@mysmsbusiness.com; provided, however, that we ask individuals to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others or would be extremely impractical (for instance, requests concerning information residing on backup tapes). Please be advised that deleting your personal information will limit our ability to contact you in connection with the My SMS Business Services. If you wish to be contacted by us in connection with the My SMS Business Services, you may not delete the personal information that we have on file for you. 

 

Changes to this Privacy Policy: My SMS Business, in our sole discretion, may amend this Privacy Policy from time to time. The latest version of this Privacy Policy will be posted on the Site, and you should review this Privacy Policy prior to using the Site and/or the Services offered by My SMS Business. By your continued use of the Site and/or the Services offered by My SMS Business, you hereby agree to the changes to this Privacy Policy. It is recommended that you should regularly check the Site for updated terms and conditions as well as the Privacy Policy.  

 

CALIFORNIA PRIVACY RIGHTS: Good Rep Media dose not currently respond to browser “Do Not Track” (DNT) signals or other mechanisms. Third parties may collect personal information about your online activities over time and across sites when you visit the Site or use the service.

If you are a California resident, California Civil Code Section 1798.83 permits you to request certain information regarding our disclosure of personal information to third parties for the third party’s direct marketing purposes. Our site, products, and services are not intended to appeal to minors. However, if you are a California resident under the age of 18, and a registered user of our Site and/or Service, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. To make such a request, please send an e-mail with a detailed description of the specific content or information to contact@goodrepmedia.com. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

Under California law, California residents who have an established business relationship with Good Rep Media may opt-out of our disclosing personal information about them to third parties for their marketing purposes.
